These Terms of Service (“Terms”) govern your access to and use of the Ark Academy platform (“Platform”), operated by Ark Academy, LLC (“Ark Academy,” “we,” “us,” or “our”). By creating an account or accessing the Platform, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Platform, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to be bound by these Terms and our Privacy Policy. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Account Creation and Registration
To access the Platform, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at academy@arkfinancial.com of any unauthorized use. Ark Academy reserves the right to refuse registration or cancel accounts at our sole discretion.
3. Subscription Plans and Billing
The Platform is offered under the following subscription tiers:
- Builder — $497/month. Access to the core Family Office Operating System playbooks, tools, and platform.
- Navigator — $1,197/month plus a one-time onboarding fee of $3,000. Includes dedicated coach assignment and full FOOS program.
- Navigator+ — $3,000/month plus a one-time onboarding fee of $10,000. Premium tier with expanded coaching, priority access, and advanced planning tools.
Subscription fees are billed in advance on a monthly basis as selected at enrollment. One-time onboarding fees are due at the time of enrollment. All fees are non-refundable except as expressly stated in our refund policy or required by applicable law.
4. Payment Processing (Square)
Payment processing services are provided by Square, Inc. (“Square”). By providing payment information, you authorize Ark Academy and Square to charge your payment method for applicable fees. Your payment information is transmitted directly to Square and is subject to Square's Terms of Service and privacy policies. Ark Academy does not store full payment card details on its servers.
5. Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Platform in any way that violates applicable law or regulation
- Share your account credentials with any third party
- Attempt to gain unauthorized access to any part of the Platform or its systems
- Scrape, harvest, or systematically extract data from the Platform without written consent
- Upload or transmit viruses, malicious code, or any other harmful technology
- Use the Platform to provide competing services or to reverse-engineer our software
- Impersonate any person or entity or misrepresent your affiliation with any person
Violation of these standards may result in immediate suspension or termination of your account.
6. Intellectual Property
All content on the Platform — including but not limited to text, graphics, logos, playbooks, course materials, financial frameworks, and software — is owned by or licensed to Ark Academy and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for your personal or internal business purposes during your active subscription. You may not reproduce, distribute, publicly display, modify, or create derivative works of any Platform content without express written permission from Ark Academy.
7. Not Financial, Tax, or Legal Advice
The Platform and all content, tools, playbooks, and coaching interactions are provided for educational and organizational purposes only. Nothing on the Platform constitutes financial advice, investment advice, tax advice, or legal advice. Ark Academy is not a registered investment advisor, broker-dealer, attorney, or licensed tax professional. The Platform does not create an advisor-client relationship. You should consult qualified professionals — including licensed CPAs, attorneys, and registered investment advisors — before making financial, tax, legal, or investment decisions. Reliance on any information provided through the Platform is solely at your own risk.
8. User Content
You retain ownership of any documents, data, or content you upload to the Platform (“User Content”). By uploading User Content, you grant Ark Academy a limited license to store, process, and display that content solely to provide the Platform services to you. You represent that you have the right to upload all User Content and that it does not violate any third-party rights.
9. Privacy and Data Security
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We implement reasonable technical and organizational measures to protect your data, including encryption in transit and at rest and row-level security on all database records. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
10. Disclaimers and Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ARK ACADEMY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARK ACADEMY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ARK ACADEMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ARK ACADEMY'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ARK ACADEMY IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
12. Term and Termination
These Terms are effective from the date you first access the Platform and remain in effect until terminated. You may terminate your account at any time by contacting us. Ark Academy may suspend or terminate your access at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, and dispute resolution — shall survive.
13. Dispute Resolution and Arbitration
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform (“Dispute”) that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall be conducted on an individual basis — class action proceedings are expressly waived.
Informal Resolution First. Before initiating arbitration, you agree to contact us at academy@arkfinancial.com and attempt to resolve the Dispute informally for at least 30 days.
Exception. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. To the extent any Dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.
15. General Provisions
Modifications. Ark Academy reserves the right to modify these Terms at any time. We will notify you of material changes by posting a notice on the Platform or by email. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Ark Academy regarding the Platform and supersede all prior agreements.
No Waiver. Ark Academy's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
